Requirements for an SB-1 Returning Resident Visa

If you are unable to return to the U.S. within the period of one year for a green card re-entry or two years for a re-entry permit, you will be required to apply for an SB-1 immigrant visa at your closest U.S. embassy or consulate abroad. You will have to establish your eligibility for this visa and will need to complete an interview and medical exam.

You will have to prove to the consulate official the following in order to be eligible:

  • That you were a legal permanent resident at the time you left the U.S. to travel abroad
  • That you fully intended to return to the U.S. as a legal permanent resident
  • That you now wish to return to the U.S. and that if your stay was prolonged, it was due to reasons beyond your control

You will have to provide documentation that supports the above requirements, such as airline tickets which prove your dates of travel, documentation that verifies your ties to the U.S., such as U.S. tax returns, proof of family or social ties, and proof that your prolonged stay was for reasons you could not control, such as with medical records, employment records, or other evidence.
