Information about NOIRs

Unlike a Request for Additional Evidence (RFE) or a Notice of Intent to Deny (NOID), which are actions of the government on a petition or application that has not been adjudicated (a final decision has not been made), a Notice of Intent to Revoke (NOIR) revokes a previously approved application or petition.

The NOIR will explain the reasons the USCIS wants to reverse their previous decision and will give the applicant or petitioner a reasonable period of time to submit evidence to show why the petition should not be revoked. The petitioner must respond within the time allotted or the revocation will take place and the petitioner will have lost his or her immigration status.

Sometimes the government may issue a NOIR in error, but proper procedures must still be followed and deadlines must still be met in order to maintain your lawful status in the United States.

NOIRs generally are issued when the USCIS receives new evidence about the case that shows that its approval of an application or petition was a mistake. This may happen when an immigration official comes across the new evidence or finds that circumstances have changed that would lead to a denial.
